Mandible Terms of Service

These Terms of Service ("Terms") are an agreement between you and WeirdBrains, the company that operates Mandible ("Mandible," "we," "us," or "our"). They govern your use of the Mandible applications, websites, and related services (the "Services").

Summary of the most important points (the full Terms control):

  • Mandible is a professional community for dental clinicians to share and discuss cases, with AI features that assist with administrative charting. It is not a diagnostic tool and never replaces your professional judgment.
  • You own your content. You give us a limited license to operate the Services with it.
  • We do not use identifiable patient information to train AI models. We develop and improve our AI using only data that has been de-identified consistent with the HIPAA Safe Harbor standard.
  • Protect your patients: remove all patient-identifying information before posting case content, and only upload material you have the legal right to share.
  • We will tell you in advance about material changes to these Terms and ask you to accept them. New data practices apply going forward, not retroactively.

1. Acceptance of These Terms

By creating an account, clicking to accept, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

If you accept these Terms on behalf of a dental practice or other organization, you represent that you have authority to bind that organization, and "you" includes that organization.

2. Who May Use Mandible

The Services are intended for licensed dental professionals, dental students and residents, and dental practice staff acting within their roles, who are at least 18 years old. We may request credential information, may verify it, and may suspend accounts that misrepresent professional status.

3. The Services

Mandible provides a platform for dental professionals to connect, collaborate, and share clinical cases and images; to discuss them with peers; and to use productivity and AI-assisted features, including case charting assistance. We may add, change, or discontinue features, and we will provide reasonable notice of changes that materially reduce core functionality.

4. Not Medical or Dental Advice; Professional Responsibility

The Services, including all community content and all AI features, are for informational, educational, and professional-collaboration purposes only. They are not medical or dental advice, and they are not a substitute for the professional judgment of a licensed clinician. No clinician-patient relationship is created through the Services, and peer discussion on Mandible is generalized professional discussion, not treatment of a specific patient.

You are solely responsible for all clinical decisions, for the care of your patients, and for compliance with the laws, regulations, and professional standards that apply to your practice.

5. AI Features

Parts of the Services use artificial intelligence ("AI Features"). For example, the charting assistant analyzes an uploaded image and suggests administrative charting information, such as tooth numbering and notation of existing dental work visible in the image, for your review.

You must independently review, and confirm or correct, every AI suggestion before relying on it. AI Features provide administrative and organizational assistance only. They do not detect, diagnose, or evaluate disease or pathology, and they are not intended to diagnose, treat, cure, mitigate, or prevent any disease or condition. Do not use AI Features as a clinical decision-support tool or as a basis for diagnosis or treatment.

AI outputs may be inaccurate or incomplete. You agree not to rely on AI outputs as a sole source of truth or as a substitute for independent verification. AI Features may be powered in part by third-party AI models and infrastructure operating under contractual data-protection commitments, including a business associate agreement between Mandible and its cloud infrastructure provider; we are not responsible for errors attributable to underlying third-party models. AI outputs that become part of your case record are treated as your User Content; Mandible retains all rights in the underlying AI systems, models, and technology.

Your use of AI Features must comply with the laws and disclosure obligations that apply to your use of AI in connection with patient care, and you are responsible for obtaining any consents or authorizations those laws require.

6. Patient Privacy and Clinical Content

(a) De-identify before you post. The Services are designed for de-identified clinical content. Before posting case content, you must remove all patient-identifying information, consistent with the HIPAA Safe Harbor standard (45 C.F.R. § 164.514(b)), including: names; geographic subdivisions smaller than a state; dates (other than year) directly related to an individual; telephone numbers, email addresses, and other contact details; medical record, account, and other identifying numbers; device identifiers; biometric identifiers; full-face photographic images and any comparable identifiable images; and any other unique identifying number, characteristic, or code. Do not include patient-identifying information in titles, captions, comments, or messages. You represent that, for each case you post, you have removed identifying information and have no actual knowledge that the content could be used, alone or in combination with other information, to identify the patient.

(b) Our tools do not shift your duty. The Services may include features intended to help detect or remove identifying information, such as automated screening of uploaded images. These features are provided as an additional safeguard. They do not release you from your own obligations under applicable law and professional standards to de-identify content before posting it.

(c) Patient consents are your responsibility. You are solely responsible for obtaining and maintaining all patient consents and authorizations, and all other legally necessary permissions, required to upload, store, transmit, display, or discuss the clinical content you handle through the Services. This responsibility survives termination of these Terms.

(d) The Services are not for identifiable patient information. Mandible does not currently offer the Services for the storage or transmission of identifiable patient information or protected health information ("PHI") as defined by HIPAA, and you must not upload it. As an additional safeguard, the Services run on cloud infrastructure provided to Mandible under a business associate agreement with our cloud provider. If we offer features for covered entities involving PHI in the future, those features will be governed by a Business Associate Agreement between you or your organization and Mandible, which will control over these Terms with respect to PHI.

(e) Community content is not private. Content you post to community areas is visible to other users according to your sharing settings, and you should have no expectation of confidentiality in it. Do not post anything you are not permitted to share.

7. Your Content and License to Mandible

You retain ownership of the content you submit to the Services, including case images, case information, posts, comments, messages, profile information, and your confirmations or corrections of AI suggestions ("User Content").

You grant Mandible a non-exclusive, royalty-free, fully paid, worldwide, sublicensable (to our service providers), transferable (in connection with a merger, acquisition, or sale of assets) license to host, store, reproduce, modify (for technical purposes such as formatting, thumbnails, and de-identification), display, distribute, and otherwise use your User Content for the purposes of operating, providing, securing, and improving the Services, consistent with these Terms and our Privacy Policy.

This license is purpose-bounded by design: our rights to use de-identified data are stated separately and exclusively in Section 8, and nothing in this Section 7 grants us the right to use identifiable User Content to train AI models.

You represent and warrant that you own your User Content or have all rights, licenses, consents, and releases necessary to post it and to grant this license, and that your User Content and your posting of it do not violate any law (including health-privacy laws) or any third party's rights.

We may remove or restrict User Content that violates these Terms or applicable law.

8. De-Identified Data and AI Development

This section describes the only way Mandible uses your content for research and AI development.

(a) What we do. Mandible may create de-identified versions of User Content (including clinical images, case information, and charting confirmations or corrections) consistent with the HIPAA Safe Harbor de-identification standard, 45 C.F.R. § 164.514(b), including removal of the identifier categories listed in Section 6(a) and screening images for embedded identifying information.

(b) What de-identified data is. Information de-identified consistent with that standard does not identify you or any patient, and is not protected health information.

(c) How we use it. We may use and retain de-identified data, during and after your use of the Services, for research, analytics, benchmarking, service improvement, and the development and training of machine-learning models and new features. De-identified data derived from your User Content may be retained after you delete content or close your account.

(d) What we promise. We do not use identifiable patient information to train AI models. Model development and training use only data that has been de-identified as described above. We do not sell identifiable User Content, and we do not permit third parties to use your identifiable User Content to train their AI models.

9. Acceptable Use

You agree not to:

  • violate any applicable law or regulation, or post content you lack the right to post;
  • post patient-identifying information (see Section 6);
  • provide false professional credentials or impersonate any person;
  • harass, defame, or threaten others, or post content that is unlawful, fraudulent, or deceptive;
  • access or use the Services by automated means (bots, crawlers, scrapers) without our prior written consent;
  • copy, extract, or use content from the Services, including other users' content and AI outputs, to train, fine-tune, or develop any machine-learning or AI model, or include it in any dataset for those purposes, without our prior written consent; unauthorized AI-training use may result in immediate termination and legal action;
  • probe, scan, or test the vulnerability of the Services, interfere with their operation, or attempt unauthorized access to accounts or systems;
  • use the Services to send spam or unsolicited commercial messages;
  • use the Services for any purpose prohibited by Section 5, including diagnostic use of AI Features, or in any situation where failure of the Services could lead to death or personal injury.

10. Intellectual Property; Feedback

The Services, including software, design, text, graphics, logos, AI systems and models, and all other materials provided by Mandible, are owned by Mandible or its licensors and protected by intellectual-property laws. Except for the limited right to use the Services in accordance with these Terms, no rights are granted to you.

If you send us feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without restriction or obligation to you.

11. Fees

Parts of the Services are offered free of charge; others may require payment, such as subscriptions or usage-based credits for certain features. Prices, billing terms, and renewal and cancellation mechanics will be presented at purchase and may be updated with notice. Taxes may apply.

12. Third-Party Services

The Services may link to or interoperate with third-party sites and services. We are not responsible for their content, privacy practices, or availability. Your use of them is governed by their own terms.

13. Termination

You may stop using the Services and request account deletion at any time. We may suspend or terminate your access for violation of these Terms, for risk to other users or patients, or as required by law; where practicable we will give notice and an opportunity to cure non-serious violations.

Upon account deletion we will delete or de-identify your User Content within a commercially reasonable period, except that we may retain: (i) content and records as required by law or for legitimate business purposes such as security, dispute resolution, and completion of backup cycles; (ii) content other users have legitimately interacted with (for example, your comments in another clinician's case discussion, which may be reattributed to a deleted-account placeholder); and (iii) de-identified data as described in Section 8. Sections that by their nature should survive termination do survive, including Sections 4 through 10 and 13 through 19 and your representations regarding patient consents.

14. Disclaimers

THE SERVICES AND ALL CONTENT, INCLUDING AI OUTPUTS, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WITHOUT LIMITING THE FOREGOING, MANDIBLE DOES NOT WARRANT THAT AI OUTPUTS ARE ACCURATE OR COMPLETE, THAT DE-IDENTIFICATION OR SCREENING FEATURES WILL IDENTIFY ALL IDENTIFYING INFORMATION, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

MANDIBLE IS NOT ENGAGED IN THE PRACTICE OF DENTISTRY OR MEDICINE. NO CONTENT OR FEATURE OF THE SERVICES CONSTITUTES MEDICAL OR DENTAL ADVICE, DIAGNOSIS, OR TREATMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) MANDIBLE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY; (B) MANDIBLE WILL NOT BE LIABLE FOR ANY CLINICAL, DIAGNOSTIC, OR TREATMENT DECISION MADE BY ANY CLINICIAN, INCLUDING DECISIONS INFORMED BY AI OUTPUTS OR COMMUNITY CONTENT; AND (C) MANDIBLE'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID TO MANDIBLE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.

16. Indemnification

You will defend, indemnify, and hold harmless Mandible and its officers, directors, employees, and agents from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your User Content; (b) your breach of these Terms or of your representations, including your obligations regarding patient identifiers, patient consents, and authorizations; (c) your use of the Services in violation of law, including health-privacy laws; or (d) your clinical, diagnostic, or treatment decisions.

17. Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-laws rules. You and Mandible consent to the exclusive jurisdiction and venue of the state and federal courts located in North Carolina for any dispute arising out of or relating to these Terms or the Services.

18. Changes to These Terms

We may update these Terms. If a change is material, we will notify you at least 30 days before it takes effect, by email or in-app notice, and we will ask you to affirmatively accept the updated Terms before continuing to use the affected Services.

Changes to how we use data apply prospectively. We will not apply a new or materially expanded data practice, including any new use of User Content for AI development, to content collected before the change took effect unless you affirmatively consent to that application.

19. General

These Terms, together with the Privacy Policy and any additional terms presented for specific features, are the entire agreement between you and Mandible regarding the Services. If any provision is unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets, with notice to you. Notices to you may be given by email to your account address or in-app.
